Please read these Terms carefully before using Offseason. By accessing or using the app, you agree to be bound by these Terms.
01 Acceptance of Terms
By downloading, installing, or using Offseason ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the App. These Terms constitute a legally binding agreement between you and Offseason ("we," "us," or "our").
02 Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the App. Offseason is intended for athletes, coaches, and sports communities. By creating an account, you represent that the information you provide about yourself is truthful and accurate.
03 User Accounts
Offseason uses Google Sign-In and Sign in with Apple for authentication. By creating an account, you agree to:
- Provide accurate information during registration and on your profile
- Keep your account information current and accurate
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
You may not create an account on behalf of another person or use a false identity. We reserve the right to suspend or terminate accounts that contain false, misleading, or inappropriate information.
04 Acceptable Use
You agree not to use the App to:
- Harass, bully, threaten, or intimidate other users
- Post content that is hateful, discriminatory, obscene, or sexually explicit
- Send, share, or upload photos or videos — in chats or anywhere else in the App — that are obscene, sexually explicit, harassing, violent, or otherwise violate these Terms
- Send, request, or share any sexually explicit, exploitative, or inappropriate imagery involving minors, or use chats or media sharing to harass, groom, or endanger any user
- Impersonate another athlete, coach, or any other person
- Impersonate or falsely claim to represent a real team, school, or organization
- Create teams for the purpose of harassing, excluding, or targeting other users
- Abuse captain privileges, including removing members in bad faith or pinning content that violates these Terms
- Share another user's personal information without their consent
- Post content that infringes on the intellectual property rights of others
- Post, upload, or share music, footage, or other third-party content that you do not have the rights to use
- Use the app for any commercial solicitation or spam
- Attempt to gain unauthorized access to other users' accounts or our systems
- Violate any applicable local, state, national, or international law
- Use the app while your account is suspended or banned, or attempt to create a new account to circumvent a suspension or ban
- Tag or @mention other users in a harassing or unwanted manner
- Distribute team invite codes in ways intended to harass team members, such as sharing codes publicly to enable spam joins
We reserve the right to remove any content and suspend or terminate any account that violates these guidelines, at our sole discretion.
05 User-Generated Content
Offseason allows you to post content including text posts, profile information, photos, videos, Moments, sport tags, team names, team chat messages, pinned messages, photos and videos shared in chats, posts shared into chats, and other team-related content ("User Content"). You retain ownership of your User Content. You are solely responsible for the photos, videos, and other content you upload, send, or share, including in private chats, and you represent that you have the right to share it. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and reproduce your content (i) within the App in connection with operating its features, including feeds, profiles, leaderboards, suggested athlete discovery, team rosters, team chats, direct messages, and profile share cards, and (ii) for promotional purposes related to the App, including in marketing materials, social media posts, press, and on joinoffseason.com.
Photos, videos, and posts you send in a chat are shared only with the participants of that chat and are not used for promotional purposes.
You understand that other users may view your posts, profile, and activity according to your privacy settings. If your account is public, your content is visible to all Offseason users. Profile pages and posts may also be accessible via shareable links such as joinoffseason.com/profile/[username] and joinoffseason.com/post/[id], which open the App when installed or direct visitors to the App Store when not.
06 Leaderboard, Badges & Featured Content
Offseason features a weekly leaderboard that ranks posts by engagement within sport categories. Users may earn or be granted various recognition features within the app, including specialty badges (such as Pioneer, Founder, or Ambassador badges), leaderboard badges, and "Highlight of the Week" featured post status. These recognitions are purely for visibility within the app and carry no monetary value or guarantee of any external benefit. We reserve the right to award, modify, or revoke any badge or featured status at our sole discretion.
07 Teams & Captains
Offseason allows you to create and join teams. Any user may create a team and becomes the initial captain of that team. Captains may invite others to join, approve or deny join requests, promote other members to captain, remove members, edit pinned messages, change join mode settings, and delete the team.
Captain status is a privilege conferred at our sole discretion, not a right. Captains act on behalf of their teams and not as agents, employees, or representatives of Offseason. Captain decisions do not bind Offseason and we may, at our sole discretion, override, modify, or revoke captain actions, including removing a captain or restoring a removed member. Captains remain bound by these Terms in all team-related conduct, and abuse of captain privileges may result in account suspension or termination.
By joining a team, you understand that other team members will be able to see your profile information, posts, and activity to the extent necessary to participate in the team, including your username, profile photo, role on the team, and any messages you send in team chat or moments visible to teammates. Joining a team does not change your overall account privacy setting.
08 Child Safety & Zero Tolerance
Offseason has zero tolerance for child sexual abuse and exploitation (CSAE) and for any content or conduct that sexualizes, endangers, or harms minors. This includes child sexual abuse material (CSAM), grooming, sextortion, and the solicitation or sharing of inappropriate imagery involving anyone under 18.
Any content or behavior of this kind is strictly prohibited across all features of the App, including posts, profiles, direct messages, team chats, and any photos or videos shared in chats. We remove violating content, permanently ban the accounts responsible, preserve relevant information, and report to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law.
You can report any user, post, message, or piece of content directly in the App, or by contacting [email protected]. You can also block any user at any time. Reports involving child safety are treated as our highest priority.
09 User Content & No Obligation to Monitor
User Content, including messages, photos, and videos shared in chats, reflects the views of the users who create it and not those of Offseason. We do not endorse and are not responsible for any User Content.
We do not pre-screen or actively monitor all User Content, and we are not obligated to. We may, but are not required to, review, remove, or restrict any User Content or account at our sole discretion, with or without notice. You use the App and interact with other users and their content at your own risk. To the fullest extent permitted by law, Offseason is not liable for User Content or for the conduct of any user, whether on or off the App.
10 Intellectual Property
All app design, code, branding, logos, and non-user-generated content are the property of Offseason and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
11 Copyright & DMCA
You are responsible for ensuring you have the rights to any content you post, including any music, footage, images, or other third-party material contained within it. Posting content you do not have the rights to use is prohibited.
Offseason respects the intellectual property rights of others and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). If you believe content on the App infringes your copyright, please send a notice to [email protected] that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material that is claimed to be infringing and its location in the App; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We will remove infringing content and, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
12 No In-App Purchases
Offseason is currently free to use and does not offer in-app purchases or subscription services. This may change in the future, and any such changes will be reflected in an updated version of these Terms.
13 Assumption of Risk
Offseason may allow you to connect and communicate with other athletes, teams, and users, some of whom you may not know. We do not conduct background checks on users and are not responsible for the conduct of any user, whether online or offline. Any interactions you have with other users, including any decision to meet in person, attend an event, or share personal information, are solely at your own risk. You are responsible for taking reasonable precautions in all interactions with other users.
14 Disclaimers
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or available at all times. We are not responsible for the accuracy of user-provided profile information, including athletic credentials, school affiliations, or sport experience claimed by users.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15 Limitation of Liability
To the maximum extent permitted by applicable law, Offseason and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your access to or use of (or inability to access or use) the App
- Any content posted, sent, or shared by other users on the App
- Any reliance placed on user profile information, including recruiting-related information
- Unauthorized access to or alteration of your account or content
- Actions taken by team captains in their management of teams you join
- Any interaction or dispute between you and any other user, on or off the App
To the maximum extent permitted by applicable law, our total aggregate liability for any and all claims relating to the App will not exceed one hundred U.S. dollars ($100), or the amount you have paid us in the twelve months preceding the claim, whichever is greater. Because the App is free to use, this amount is typically zero.
16 Indemnification
You agree to defend, indemnify, and hold harmless Offseason and its affiliates, founders, employees, and agents from any claims, damages, liabilities, or costs arising from your use of the App, your User Content, or your violation of these Terms.
17 Dispute Resolution & Class Action Waiver
Please read this section carefully, as it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App that cannot be resolved informally will be resolved through binding individual arbitration, rather than in court, except that you may bring claims in small claims court if they qualify. Before starting arbitration, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Class Action Waiver. You and Offseason agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and Offseason waive any right to a jury trial and to participate in a class action.
Nothing in this section prevents either party from seeking injunctive or equitable relief for matters related to intellectual property, unauthorized access, or misuse of the App. If any portion of this section is found unenforceable, the remainder will continue to apply, except that the class action waiver is non-severable — if it is found unenforceable, this entire dispute resolution section will not apply.
18 Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Suspended accounts are temporarily restricted from accessing the App. Banned accounts are permanently restricted. The reason for suspension or ban will be communicated within the App. You may also delete your account at any time through Settings → Danger Zone → Delete Account. Upon termination, your right to use the App ceases immediately.
19 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Subject to the Dispute Resolution section above, any disputes shall be subject to the jurisdiction of the courts located in Massachusetts.
20 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
21 Changes to These Terms
We reserve the right to modify these Terms at any time. If changes are material, we will make reasonable efforts to notify users. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
